Service Terms and Conditions for Rubbish Collection St John's Wood

These Terms and Conditions set out the basis on which we provide rubbish collection and related waste clearance services in and around St John's Wood. By booking our services, you agree to be bound by these Terms and Conditions, which form a legally binding agreement between you and us. Please read them carefully before making a booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

1.1 Service means the rubbish collection, waste clearance, bulky waste removal and any related services that we provide as agreed with you.

1.2 We, us, and our refer to the rubbish collection service provider supplying the Service.

1.3 You and your refer to the customer booking and receiving the Service, whether as an individual, business, landlord, agent, or organisation.

1.4 Premises means the property or location where the Service is to be carried out.

1.5 Waste means any rubbish, junk, household waste, garden waste, commercial waste, or other materials agreed to be collected, excluding any items classed as prohibited or hazardous waste under law or these Terms and Conditions.

2. Scope of Service

2.1 We provide rubbish collection and waste removal services within our operational area, which includes St John's Wood and certain surrounding neighbourhoods. Availability may vary depending on date, time, and vehicle routing.

2.2 The Service may include one-off rubbish collection, scheduled waste removal, garden waste clearance, bulky item collection, and other related waste management tasks as agreed at the time of booking.

2.3 We reserve the right to refuse collection of any items that are unsafe to handle, not properly presented, or prohibited by waste regulations, including certain types of hazardous or clinical waste.

2.4 You are responsible for accurately describing the volume, nature, and location of the waste to be collected. Our quotation and pricing will be based on the information you provide, subject to clause 6.

3. Booking Process

3.1 You may request a booking for rubbish collection by telephone or email. We will confirm whether we can accept your requested date and time and will provide an estimated price or pricing structure based on the information supplied.

3.2 A booking is only confirmed when we have accepted your request, provided you with a confirmation, and you have agreed to any applicable charges. We may, at our discretion, request a deposit or full payment in advance.

3.3 When making a booking, you must provide accurate contact details, the full address of the Premises, access instructions where relevant, and full details of the Waste to be collected.

3.4 For commercial customers or managing agents, we may agree to a recurring or scheduled rubbish collection arrangement. Any such arrangements will be subject to these Terms and Conditions and any additional written agreement between us.

4. Access and Customer Responsibilities

4.1 You must ensure that we have safe, reasonable, and timely access to the Premises at the agreed time. This includes making sure that:

a. Any gates, doors, or access routes are unlocked or accessible.

b. Parking or loading space is available for our vehicle as close as reasonably possible to the Premises.

c. The Waste is ready for collection and is not obstructed by other items or vehicles.

4.2 You are responsible for ensuring that the Premises are safe for our staff to enter and work in. We may refuse to proceed with the Service, or we may stop work, if we consider that the conditions are unsafe, unsanitary, or otherwise unsuitable.

4.3 If we cannot gain access to the Premises, or the Waste is not available for collection, or we are delayed due to circumstances within your control, we may charge a missed collection fee or a reasonable waiting time charge.

4.4 You must inform us in advance of any special circumstances that may affect the Service, such as limited vehicle access, parking restrictions, or the presence of fragile surfaces, fixtures, or fittings.

5. Waste Types and Prohibited Items

5.1 We collect general household rubbish, commercial non-hazardous waste, garden clippings, bulky furniture, appliances, and similar materials, subject to capacity and regulatory limits.

5.2 We do not collect certain hazardous or prohibited items, including but not limited to:

a. Asbestos or materials containing asbestos.

b. Clinical or medical waste.

c. Corrosive, flammable, explosive, or toxic substances.

d. Gas cylinders or pressurised containers.

e. Certain chemicals, oils, paints, and solvents, unless we have specifically agreed and are licensed to do so.

5.3 You must declare any items that may be hazardous or require special handling at the time of booking. If we discover prohibited items on arrival, we may refuse to collect them and may charge for any time and costs incurred.

5.4 We reserve the right to decline any waste that we reasonably believe would breach waste regulations, health and safety laws, or our licence conditions.

6. Pricing and Payments

6.1 Our prices for rubbish collection and waste clearance are based on factors such as volume, weight, type of waste, access conditions, and labour required.

6.2 Any quotation provided before attending the Premises is an estimate only, based on the information you supply. The final price may be adjusted on site if the actual volume, weight, or nature of the Waste differs from that described, or if access is more difficult than indicated.

6.3 Unless otherwise agreed in writing, payment is due on completion of the Service. We may require payment in advance or a deposit, especially for larger jobs or commercial contracts.

6.4 We accept payment by cash, card, or other methods that we make available. You agree to pay all charges promptly and in full.

6.5 For business customers and account holders, payment terms will be as agreed in writing. If payment is not made by the due date, we may charge interest on overdue amounts at the statutory rate permitted under UK law, and we may suspend further services until payment is received.

6.6 All prices are exclusive of any applicable value added tax or similar taxes, which will be added at the prevailing rate where applicable.

7. Cancellations and Rescheduling

7.1 You may cancel or reschedule your rubbish collection by giving us reasonable notice.

7.2 For standard bookings, if you cancel more than 24 hours before the agreed arrival time, no cancellation fee will usually apply. If you cancel within 24 hours, we may charge a cancellation fee to cover our costs and lost booking slot.

7.3 For large or specialised jobs, or where we have hired equipment or additional labour, different cancellation terms may apply. Any such terms will be confirmed at the time of booking.

7.4 If we are unable to carry out the Service due to events outside our reasonable control, such as severe weather, road closures, vehicle breakdown, or illness, we will notify you as soon as reasonably practicable and arrange a new appointment. We will not be liable for any loss arising from such delays or cancellations, but any payment already made for the affected Service will be applied to the rescheduled booking or refunded if rescheduling is not possible.

8. Performance of the Service

8.1 We will carry out the rubbish collection with reasonable care and skill, complying with applicable waste regulations and environmental obligations.

8.2 Our team will load the Waste onto our vehicle and will take reasonable care to avoid damage to property while carrying out the collection. However, you should remove or protect any fragile or valuable items in the vicinity of the work area.

8.3 Unless otherwise agreed, we do not provide cleaning, repair, or making good services. Once the Waste is removed, you are responsible for any additional tidying or cleaning that you require.

8.4 All times given for arrival or completion are estimates and are not guaranteed. Traffic, access issues, and previous jobs can affect timings. We will use reasonable efforts to keep you informed of any significant delay.

9. Title and Disposal of Waste

9.1 Once we load the Waste onto our vehicle and accept it for collection, title and responsibility for that Waste transfers to us, subject to any contrary legal obligations.

9.2 We will transport and dispose of the Waste in accordance with applicable UK waste regulations, including duty of care requirements. We use licensed waste transfer stations or disposal facilities as required by law.

9.3 We may separate, recycle, or recover materials from the Waste as part of our waste management processes. You acknowledge that we are entitled to make such decisions at our discretion.

10. Liability and Limitations

10.1 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be lawfully limited or excluded.

10.2 Subject to clause 10.1, we will not be liable for:

a. Any loss of profits, business, revenue, or anticipated savings.

b. Any loss of or damage to goodwill or reputation.

c. Any indirect or consequential loss or damage.

10.3 Our total liability for any loss or damage arising out of or in connection with the Service, whether in contract, tort, or otherwise, shall be limited to the total amount paid or payable by you for the specific Service giving rise to the claim.

10.4 We are not liable for damage to surfaces, driveways, or access routes that are not suitable for heavy vehicles or equipment, where you have requested or agreed that we use them. It is your responsibility to advise us of any weight or access limitations.

10.5 We are not responsible for items that you intended to retain but which were mistakenly presented as Waste and collected. You must ensure that personal belongings and valuable items are separated from the rubbish before we arrive.

11. Customer Warranties

11.1 You warrant that you are either the owner of the Waste and the Premises, or that you have full authority from the owner to authorise its removal and to enter into this contract.

11.2 You warrant that none of the Waste is hazardous, prohibited, or otherwise unsuitable for collection under these Terms and Conditions or relevant regulations, unless you have expressly informed us and we have agreed in advance to collect it.

11.3 You agree to indemnify us against any loss, damage, cost, or liability arising from any breach of the warranties in this section, or from any failure to comply with these Terms and Conditions.

12. Data Protection and Privacy

12.1 We will process your personal data in order to manage your booking, provide the Service, process payments, and handle customer service enquiries.

12.2 We will take reasonable steps to keep your personal data secure and will not share it with third parties except where necessary to deliver the Service, comply with legal obligations, or as otherwise permitted by law.

13. Complaints and Disputes

13.1 If you are dissatisfied with any aspect of the rubbish collection Service, you should contact us as soon as possible with details of your concern.

13.2 We will investigate complaints in a fair and timely manner and will aim to resolve issues by repair, re-performance of the Service where appropriate, or by another agreed remedy.

13.3 These Terms and Conditions do not affect any statutory rights you may have as a consumer under UK law.

14. Changes to Terms and Conditions

14.1 We may update or amend these Terms and Conditions from time to time. Any changes will take effect for new bookings from the date they are published or otherwise communicated to you.

14.2 The Terms and Conditions in force at the time of your booking will apply to that specific Service, unless we agree otherwise in writing.

15. Governing Law and Jurisdiction

15.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Service, shall be governed by and construed in accordance with the laws of England and Wales.

15.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Service, including any non-contractual disputes or claims.

16. General Provisions

16.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful, or unenforceable, that provision shall be treated as deleted, but the remaining provisions shall continue in full force and effect.

16.2 No waiver of any breach of these Terms and Conditions shall be considered a waiver of any later breach of the same or any other provision.

16.3 You may not assign or transfer your rights or obligations under these Terms and Conditions without our prior written consent. We may assign or subcontract our rights and obligations where necessary to perform the Service, provided this does not materially affect your rights.

16.4 These Terms and Conditions, together with any written confirmation of your booking and any agreed variations, constitute the entire agreement between you and us in relation to the Service.
